Experience

  • Regularly advises captive insurance companies and risk retention groups on all aspects of their formation and operations including corporate governance, complex, multijurisdictional loss portfolio transfers, redomestications, and disputed withdrawals. Clients include Fortune 500 companies, non-profits, and small, family-run businesses. Industries include higher education, hospital systems, manufacturing and financial institutions.
  • Counsel to the debtors (a large financial institution and its affiliates) for six years in chapter 11 cases arising out of the 2008 financial crisis, including: the negotiation, litigation and settlement of claims filed by Fannie Mae and various large banks and hedge funds; the sale and other disposition of significant real estate assets owned by the debtors; and the resolution of related adversary proceedings pending in the United States Bankruptcy Court.
