Walter Judge secures dismissal of “happy cows” suit against Ben & Jerry’s
Litigation partner Walter Judge assisted in securing a victory for Ben & Jerry’s, which was sued in federal court by environmental advocate James Ehlers, who alleged the company misled customers with their “happy cows” messaging. U.S. District Judge Christina Reiss dismissed Ehlers’ claim and proposed class action on grounds that the messaging was based on opinion and that the plaintiff failed to show that consumers purchase their ice cream based on such claims.
